Specific Rules

 

1.         Competition Start Date

1.1 The competition will open at 00:00 on 28/08/223 as a premium text line competition.

1.2 The competition will close at 23:59 on 07/09/2023.

 

2.            Mechanic

2.1 Listeners will be asked to text the keyword "HOLIDAY" to 84902 and the answer to this following question for their chance to win the prize. The answer format must be ‘HOLIDAY X’ to enter the draw.

‘What is the capital of Jamaica?’

1. ‘Kingston’
2. ‘Edinburgh’
3. ‘Rome’

2.2 There will be one winner chosen at random from all the correct answers on Friday 08/09/2023 at 08:00 to win the prize.

2.3 Entry into these Rounds requires a text to 84902 with an answer in the format of, ‘HOLIDAY X’. A correct entry does not confirm that you will be chosen to come on air to win the prize. From all the entrants with the correct answer across the week, one person at random using a computer-based system, will be selected to be called to air on the Friday 08/09/23.

2.4 We reserve the right to select another entrant if you do not pick up our phone call. We will ring the entrant first selected to win three times before moving to select another if there is a failure to answer the call. If you fail to answer the phone three times, you waive your right to claim the prize in that round.

2.5 The competition is open on the 28/08/2023 at 06:00 and is open until 07/09/2023 at 23:59. The first mention of entering the competition on Radio Essex will be post 06:00 but still on 21/08/23.

2.6 Texts outside of these specific times may not count but may still be charged. During the active competition, you may enter a maximum of 8 times per day. The text limit is replenished every active day of the competition until the closing date.

2.7 Texts will enter a pool of correct answers that will accumulate across the competition. These texts become the pool from which we will pull from on the 08/09/23.

 

            3.         Premium Rate Text

3.1 Premium Rate Text competitions incur a fee That is charged to your mobile phone bill or deducted from your credit balance.

3.2 Premium Rate Services are only activated when you send a text to a 5-digit number. Radio Essex will clearly inform you when there is a charge attached to entering a competition.

3.2.1 Radio Essex’s Friday Payday is a premium rate text line competition with a charge of £2 plus your standard network rate. This charge is per text you send to a short code (5-digit number).

3.2.1 Radio Essex is also running a ‘Buy One Get One Free’ deal on the premium rate text line. You will be made aware of this via SMS from 84902 at your time of entry. This means one text will automatically give you a free entry (counting as a second entry). Bonus entries count as real entries.

3.3 Payment for your participation in this competition will come through your mobile phone provider. This may appear as two separate charges.

3.4 If you text to our short code while the competition is in-active with the keyword (stated by the on-air presenters), your entry will not count but you may still be charged.

4.         Prize

4.1 One randomly selected entrant, who has correctly text to 84902 the answer to the selected question & answered the call from Radio Essex within 3 attempts, will receive an all-inclusive seven-night stay in Jamaica in a Sandals Resort. This includes return economy flights & resort transfers in Jamaica. Terms and conditions for the accommodation part of the prize from Unique Vacations UK (representatives of Sandals Resorts in the UK).

The Prize:

One seven-night (7), Luxury Included® (all-inclusive) accommodation-only holiday for two (2) adults at a Sandals Resort in Jamaica in one deluxe room with a king size bed (subject to availability and selected blackout dates). Flights for the redemption of the Sandals Prize Package are provided by the Jamaica Tourist Board and must be booked once the accommodations have been confirmed.

The resort accommodations are inclusive of all meals, unlimited premium brand beverages, daily & nightly entertainment, an array of land and water sports activities, including scuba diving (for certified divers), snorkelling, Wi-Fi in all rooms and public areas, resort gratuities, resort taxes and resort transfers to and from the selected or designated resort’s airport.

The Prize excludes: Domestic transfers, including any internal flights or transportation to the UK departure airport, spending money, telephone calls, Red Lane® Spa treatments and services, specialty dining, tours & excursions, inter-island transportation, SCUBA certification courses, island departure taxes and purchases made at the Sandals Resorts Specialty Shops. All expenses and incidental travel costs not expressly stated in the Prize package description, including but not limited to, all ground transportation (outside of local airport transfers in the Caribbean), travel insurance, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees and taxes. Holiday insurance, Covid tests, Visas and ESTA’s are not included and must be purchased before travel, if required.

The Accommodation part of the Prize for Redemption Purposes only is: Unique Vacations UK Ltd., an affiliate of the worldwide representative for Sandals Resorts, located 2nd Floor, Nucleus House, 2 Lower Mortlake Rd, Richmond TW9 2JA.

There will only be one (1) winner. Prize winner and their travel companion must be over 18 and must travel on the same itinerary.

Passports are required for international travel and must have at least six months validity from when your trip finishes (i.e., the date you travel home).

The Holiday cannot be taken during peak seasons (Easter, July, August, December and New Year) and cannot be confirmed until 90 days prior to departure. Blackout dates and restrictions apply. Sandals Resorts’ Blackout dates include but are not limited to: 18th – 29th November 2023, 26th – 31st December 2023, 1st – 3rd January 2024, 17th – 23rd February 2024 and 11th March – 16th April 2024. Once dates are confirmed there will be an administration fee for any changes made to the reservation. This fee varies in accordance with the airline.

The Prize must be redeemed before 8th September 2024. Prize is strictly non-transferable; no cash alternative is available, and the prize cannot be redeemed for cash. If the winner is unable to redeem the Prize within the specified time the Prize will be forfeited.

Sandals Resorts are for couples and all accommodations include one king size bed.

Winner can choose to stay at Sandals Montego Bay, Sandals Royal Caribbean Resort & Private Island, Sandals South Coast, Sandals Negril Beach Resort & Spa, Sandals Ochi Beach Resort or Sandals Dunn’s River. Subject to availability. First choice may not be available. Prize excludes Sandals Royal Plantation.

Sandals Resorts reserves the right to relocate the Prize winner from the stated resort to an alternative Sandals Resort if rooms become unavailable for the travel dates booked due to any circumstance beyond their control. Sandals Resorts reserves the right to substitute the selected resort for another resort in the selected resort’s chain in a similar category based on availability of space for the secured travel dates, and to change dates without prior notice for any circumstance(s) beyond the selected resort’s control and if such circumstance(s) so require. The Terms and Conditions agreed to shall apply with equal applicability to any resort, which is the subject of substitution or deviation. Neither Unique Vacations (UK) Ltd. nor Sandals Resorts shall be liable for any claim made whatsoever, including but not limited to loss, compensation, or refund by reason of such substitution or deviation.

Prize value is an approximate value only based on select travel dates.

4.2 Prize will be negotiated with third party for dates of stay.

4.3 To claim the prize you must be able to send us proof of ID. Failure to do so can result in Radio Essex withdrawing the prize. Radio Essex reserve the right to do this.

            5.         Entering

5.1 You must be over 18 at the time of entry to the competition. Any entry below the age of 18 will not count but may still be charged.

5.2 You must be the bill payer or have the bill payer’s permission to enter this Radio Essex competition.

5.3 If you are an Exempt Individual (an employee, freelancer, contractor or in any way affiliated to Radio Essex or the Stockvale Group) you cannot enter. If you do enter, your entry will not count but may still be charged.

5.4 As this competition requires a phone call to take part in the ‘skill-based’ competition (a competition that requires a correct answer to win). If you have entered and are chosen as a potential ‘winner’, Radio Essex will attempt to ring you. After three failed attempts we will have to move on to another entrant & you forfeit your right to win the prize.

5.5 Entrants can enter up to eight times per day, excluding bonus entries that you accumulate with the Buy One Get One Free Deal Radio Essex are running.

5.6 PRIVACY POLICY/USE OF DATA: ONLY THE NAME AND THE CONTACT EMAIL ADDRESS OF THE PRIZE WINNER WILL BE PROVIDED TO THE PRIZE PROVIDER. The UK version of the General Data Protection Regulation (EU) 2016/679 which is part of UK law by virtue of the European Union (Withdrawal) Act 2018, as supplemented by the Data Protection Act 2018; provides a number of protections for use of your personal data. Any personal data collected from the Prize Winner and provided to Unique Vacations UK Ltd. as the Prize Provider and Administrator of the Prize for redemption purposes shall be subject to our privacy policy located at www.sandals.com/terms-conditions/. The Prize Provider will only use the personal data of the prize winner and travel companion for the purposes of administrating the Prize redemption, unless the Prize winner and travel companion provide express consent signifying their agreement to any other processing or use of their personal data. For Prize redemption purposes the personal data collected from the Prize winner and travel companion will be shared with the Prize Provider’s reservations affiliate and the resort which are both located outside of the United Kingdom.

5.7 Entering into this competition is a soft opt-in to marketing from Radio Essex, Jamaica Tourist Board & Sandals.

5.7 Employees and their immediate families of Unique Vacations UK Ltd and their associated agencies or affiliated companies are not eligible to enter to win.

5.8 The Competition is open only to legal residents of the United Kingdom who are at least eighteen (18) years of age at the time of entry (the “Entrants”). One entry per household.

5.9 Each Entrant agrees and as a condition of possibly being awarded the Prize to release and hold harmless the Prize Provider and its affiliated companies and each of their respective officers, directors, employees, agents and insurers from and against any and all claims, causes of action and/or liability for any injuries, illness, death, loss or damage of any kind arising from or in connection with participation in and/or entry into the competition or receipt or possession, use or misuse of the Prize or any element thereof.

 

6.         COVID-19

6.1 Health & Safety: The health and safety of our guests is our number one priority, and the Hotel reserves the right to implement or modify health protocols, policies and procedures at any time as needed, in keeping with public health guidance and applicable law.

6.2 Guests are responsible for checking the travel and entry protocols for the destination that they are travelling to before they depart and ensuring that they fully understand and comply with any such protocols. For example, some destinations may require all guests to be fully vaccinated and/or to obtain a negative PCR Covid-19 test a certain number of days pre-travel and post travel, to return to your original destination. Please visit the UK Foreign Commonwealth and Development Office (“FCDO”) website before travel and check the official Government website for the country you’re visiting for all pre and post travel protocols. Unique Travel Corp, Unique Vacations UK Limited and/or Sandals Resorts International Ltd. shall not be responsible for any additional costs incurred for any required test or any other pre-travel or post-travel requirements.

6.3 Compliance With Government Entities: The Unique Group, and Sandals Resorts International Limited and/or any of its related entities shall have the right to comply with any and all orders, recommendations, or directions whatsoever given by any government entity or by persons purporting to act with such authority, and such compliance shall not be deemed a breach of any agreement or any agreement entitling the guests to assert any claim for liability, compensation or refund.

6.4 All guests are required to provide evidence of comprehensive travel insurance before reservations are made for travel. Unique Travel Corp, Unique Vacations UK Limited and Sandals Resorts International Ltd. will not provide comprehensive travel insurance.

 

            7.         Other Terms & Conditions

7.1 THIS SECTION PROVIDES FOR THE EXCLUSIVE RESOLUTION OF DISPUTES THROUGH INDIVIDUAL LEGAL ACTION AND SUPERSEDES ANY LAW ENTITLING GUEST TO PARTICIPATE IN A CLASS ACTION. THIS CLASS ACTION WAIVER PRECLUDES GUEST FROM PARTICIPATING IN OR BEING REPRESENTED IN ANY CLASS OR REPRESENTATIVE ACTION REGARDING ANY CLAIM BROUGHT UNDER AS A RESULT OF ANY AGREEMENT. EVEN IF APPLICABLE LAW PROVIDES OTHERWISE, GUEST AGREES THAT ANY ARBITRATION OR LAWSUIT AGAINST ANY ENTITY UNDER THE UNIQUE GROUP AND/OR SANDALS RESORTS WHATSOEVER SHALL BE LITIGATED BY GUEST INDIVIDUALLY AND NOT AS A MEMBER OF ANY CLASS OR AS PART OF A CLASS ACTION, AND GUEST EXPRESSLY AGREES TO WAIVE AUTHORITY TO ARBITRATE CLAIMS ON A CLASS ACTION BASIS. IF GUEST'S CLAIM IS SUBJECT TO LEGAL PROCEEDING UNDER FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE ACCOMMODATIONS, AMENITIES, TRANSPORATION AND OTHER PRODUCTS OR SERVICES TERMS AND CONDITIONS (available here: www.sandals.com/terms-conditions/), THE GUEST FURTHER AGREES AND ACKNOWLEDGES THAT THE CLASS ACTION WAIVER IS MATERIAL AND ESSENTIAL TO THE

7.2 PROCEEDING OF ANY DISPUTES BETWEEN THE PARTIES AND IS NON-SEVERABLE FROM THE AGREEMENT TO ANY CLAIMS HEREIN. THE VALIDITY AND EFFECT OF THIS CLASS ACTION WAIVER MAY BE DETERMINED ONLY BY A JUDGE OR COURT OF LAW. GUEST AGREES THAT THIS SECTION SHALL NOT BE SEVERABLE UNDER ANY CIRCUMSTANCES FROM THE FORUM SELECTION AND CHOICE OF LAW PROVISION SET FORTH IN THE TERMS AND CONDITIONS. Guest agrees that the parties referenced in FOREIGN SELECTION AND CHOICE OF LAW PROVISIONS OF THE TERMS AND CONDITIONS that may be the subject of any claim by Guest can receive immediate judicial assistance to enforce this class action waiver.

7.3 Entrants should check the Gov.co.uk website for travel advice and other information prior to entering the competition.

 

            8.         Other Terms & Conditions

8.1 You must also comply with the Radio Essex Competition Terms & Conditions to participate in this competition.

8.2 Radio Essex will act in line with the Radio Essex Competition Terms & Conditions.

8.3 You must comply with Unique Vacations UK Ltd T&C’s.
